To everyone in the Xeggex community,
We would like to begin by sincerely apologizing for the length of time that has passed since our last public update. The delay was not due to inaction or disregard, but rather the result of developing circumstances that required careful review and confirmation before we could responsibly communicate them.
Unfortunately, we must now share news that we know will be deeply disappointing to everyone affected.
During the course of the recovery effort, we were informed that the individual responsible for the Xeggex exit scam—and the individual connected to the assets we were actively seeking to recover—was granted a presidential pardon by President Trump. As a matter of law, the issuance of a pardon eliminates not only criminal exposure, but also any associated financial culpability and civil liability tied to those actions.
As a result, there is no longer a legal basis upon which to pursue recovery of the assets. This is not a procedural setback, nor a matter of strategy or resources. A pardon is a permanent and absolute legal action, and there is no mechanism available to bypass, challenge, or work around its effects. This outcome is final.
Despite extensive efforts and meaningful progress made along the way, the recovery effort has now been taken entirely out of our hands. All individuals harmed in the Xeggex exit scam are, unfortunately, now permanently deprived of any legal path toward being made whole through asset recovery.
It is difficult to accept this outcome. The effort was real, the progress was real, and the intent was always to pursue every viable option on behalf of the community. Regrettably, this decision has rendered further action impossible.
Regarding the funds currently held in escrow: we will be contacting the individuals who contributed those funds directly. Since litigation will no longer proceed, a substantial portion of those funds will be returned, as they are no longer required for the purposes for which they were collected.
We are truly sorry to be the bearers of this news. We know how much hope many placed in this effort, and we share in the disappointment of this conclusion. Thank you to everyone who supported the recovery process and remained engaged throughout.
