We want to provide an important update regarding the claims process.
On advice of counsel, submission of class claims has been paused. At this stage, we are not legally permitted to collect or process class claims until the class itself is formally recognized by the court. This will occur only after:
- The legal retainer has been fully met, and
- The case is formally filed.
Until that point, any submissions of Priority Class or Basic Class claims cannot be accepted.
What This Means for You
- Primary Plaintiff Applications: These are still being accepted at this time. Primary Plaintiffs are essential to moving the legal process forward and securing the funds needed to establish the class.
- Class Claims (Priority & Basic): These will reopen once the case has been filed and the class legally exists. At that time, affected users will be notified and directed to submit under the appropriate claim category.
We understand the urgency many of you feel in securing your claims. Please know that this pause is a necessary legal requirement, not a delay of our choosing. By ensuring the process follows the proper legal structure, we maximize the likelihood of enforceable recovery for all claimants.
FAQ
Q: Why can’t class claims be collected now?
A: Class claims cannot legally exist until the class itself is formally recognized by the court. Collecting claims before that time could invalidate parts of the recovery effort.
Q: Will my eligibility change if I wait to file?
A: No. Once the class is legally established, all eligible users will have the opportunity to file their claim. Holding your documentation now will not harm your eligibility later.
Q: What can I do in the meantime?
A: If you wish to play a leading role in the case and secure a guaranteed portion of recovery, you may apply as a Primary Plaintiff. Otherwise, please keep your records safe and be prepared to submit once class claims reopen.
Q: How will I know when class claims reopen?
A: Updates will be posted here on the recovery site and notifications will be sent to registered participants.
